Agreement
These terms are a legal agreement between you (or the business you represent) and CalcCapture (“CalcCapture”, “we”, “us”). By creating an account or using the service, you agree to them. If you’re accepting on behalf of a business, you confirm you’re authorized to do so.
The service
CalcCapture provides embeddable calculators, lead capture, a contact manager, widgets, themes, webhooks and white-label features for real estate professionals in the United States. We may improve or change features over time. We’ll give reasonable notice before removing a feature that’s material to a paid plan.
Accounts
You must give accurate information, keep your credentials secure and tell us promptly about any unauthorized use. You’re responsible for activity under your account, including activity by users you invite. Only the account owner can change account-wide settings such as billing and white-label.
Plans, trials and billing
- Free plan. The Agent plan is free, with the limits shown on our pricing page.
- Trials. Monthly and yearly Team and Brokerage plans include a free trial. A payment method is required. If you don’t cancel before the trial ends, the paid plan starts. One trial per account.
- Subscriptions. Monthly and yearly plans renew automatically until cancelled. Prices are in US dollars and exclude applicable taxes.
- Lifetime plans. A lifetime plan is a one-time payment for continued access to that plan’s features for as long as we operate the service, subject to these terms and fair use.
- Plan changes. Upgrades take effect immediately and may be prorated. Downgrades take effect at the end of the billing period.
- Refunds. See our refund and cancellation policy.
Acceptable use
You won’t use the service:
- for anything unlawful, deceptive or discriminatory, including advertising that violates fair housing laws;
- to send calls, texts or emails without the consent and disclosures the law requires;
- to collect information you’re not permitted to collect;
- to attempt to breach security, overload the service or access other customers’ data;
- to reverse engineer the service, except where the law allows; or
- to resell access, except that brokerages, teams and agencies may provide calculators to their own agents and clients as part of their services.
Your content and your leads
You own the content you create and the leads your calculators capture. You give us permission to host, process and transmit it to provide the service. You’re responsible for:
- having a lawful basis and the consents needed to collect and use lead information, including for calls and texts under the TCPA and state laws;
- the disclosures, disclaimers, licensing information and privacy notices on your websites; and
- the destinations you send data to by webhook.
Calculators are estimates
Calculator results are estimates for illustration, based on visitors’ inputs and default assumptions. They aren’t financial, tax, legal or lending advice, offers of credit, Loan Estimates or pre-approvals. Statutory figures are sourced and dated but can change. You’re responsible for how calculators are presented on your sites.
Intellectual property
The service, the calculators, templates, designs and the CalcCapture brand belong to us or our licensors. While your account is in good standing, your plan gives you a limited, non-exclusive, non-transferable right to use and embed the calculators.
Suspension and termination
You can close your account at any time. We may suspend or terminate accounts that breach these terms or put the service or other people at risk. When an account ends, its embeds stop working. Export your contacts before closing your account.
Disclaimers
The service is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the service is limited to the amounts you paid us in the 12 months before the claim.
Indemnity
You’ll defend and indemnify us against third-party claims arising from your content, your leads, your websites, your communications with leads, or your breach of these terms.
Governing law
These terms are governed by the laws of the United States and of the state in which CalcCapture‘s operating entity is organized, without regard to conflict-of-law rules.
Changes
We’ll post updated terms here and revise the date above, and we’ll give notice of material changes. Continuing to use the service after changes take effect means you accept them.
